It sounds logical to me. "You can't kill innocent humans" is a perfectly consistent standard even if you believe in the death penalty. The only thing that isn't logical would be the pro-choice anti-death penalty position. If a man kidnapped and raped a woman causing her to become pregnant, it makes no sense to have no qualms about killing the innocent child but staunchly oppose killing the rapist
